Standard Terms and Conditions of Contract for Aviationlive CC T/A PickETicket.com

Application

All quotations or estimates provided by or bookings made with and/or all services rendered by or on behalf of Aviationlive CC T/A PickETicket.com. (‘the Travel Agent') are subject to the terms and conditions (‘the Conditions'), as set out below.

The Client and Authority

The person requesting quotations or estimates or making a booking or to whom any services are rendered, is deemed to have read and accepted the Conditions and to have the authority to do so on behalf of the person in whose name the estimate or quotation or reservation is requested and/or provided and/or the person to whom the services are rendered (collectively referred to as ‘the Client(s)').

AVIATIONLIVE CC T/A PICKETICKET.COM STRONGLY RECOMMENDS THAT YOU TAKE OUT INSURANCE FOR ANY HOLIDAY.

SEAT SELECTION OPTIONS/SEATING PREFERANCES/FOOD PREFERANCES AND ANY OTHER ADDITIONAL OPTIONAL PREFERANCES GIVEN TO YOU THE CLIENT ARE NOT A GUARANTEE.

Third Party Service Providers

The Travel Agent provides Clients with travel and/or other services either itself or acting as agents for principals engaged in or associated with the travel industry, such as airlines (collectively referred to as ‘the Principal'). The Travel Agent represents the Principal as agents only and accordingly accepts no liability for any loss, damage, injury, illness, harm or death which any Client may suffer as a result of any act or omission on the part of or the failure of the Principal to fulfill their obligations, whether in relation to travel arrangements, accommodation or otherwise. The contract in use by the Principal (which is often constituted by the ticket issued by the Principal), shall constitute the sole contract between the Principal and the Client and any right of recourse the Client may have, will be solely against the Principal. The Travel Agent will provide the identity, terms and conditions of all the Principals if so requested by the Client relevant to the service being provided for the Client's booking. It's the Client's responsibility to familiarize themselves with such terms and conditions (‘the Principal's Conditions').

When you make a booking via the Site, and your preferred travel product or service is available, the contract will be between the Travel Supplier and you. Aviationlive CC T/A PickETicket.com is not a party to the contractual relationship. Any queries or concerns relating to the product should be addressed to the Travel Supplier. You will see the contact details for most suppliers in the confirmation e-mail we or the Travel Supplier send you.

Aviationlive CC T/A PickETicket.com does not assume any responsibility for the travel products and services provided by the Travel Supplier and makes no representations or warranties (express or implied) about the suitability or quality of travel products and services featured on the Site.

Travel Supplier Conditions

The following applies to all products or services booked via our Site:

The Travel Supplier's terms and conditions (including airlines' fare rules) will apply in addition to those set out here. The Travel Supplier's terms and conditions may include provisions relating to payment procedures, default, liability, cancellations, changes of bookings and refunds (if available) and any other restrictions. Consequently, as you move through the Site you will see links to terms applying to specific Travel Supplier products (you are advised to read those terms carefully) - however, please refer to your particular Travel Supplier for full details as to the applicable terms and conditions.

You are responsible for complying with any airline or other Travel Supplier conditions in relation to check-in times, reconfirmation of flights, or other matters.

Flights

Please note that in relation to air fares there are additional terms specific to that fare. For example, tickets are normally non-changeable and non-refundable. You can view the fare rules when you view the Terms and Conditions during the booking process. In addition, the majority of airlines reserve the right to make schedule changes and cancel confirmed bookings. While Aviationlive CC T/A PickETicket.com, as Agent, is not responsible for such schedule changes or cancellations, we will provide you with any reasonable assistance you require via our customer services.

Airlines may charge for additional services such as checked baggage, airport check-in, preferred seating, in-flight entertainment (if available), food, drink and snacks etc. Any charges for these additional services are not included in the price of your flight ticket and must be paid to the airline directly. Aviationlive CC T/A PickETicket.com is not responsible for any additional costs incurred and advise you to contact the relevant airline to add any additional services and verify charges.

The recommended minimum check-in time for international flights is 120 minutes prior to departure and for domestic flights, 90 minutes before departure. Some airlines require you to reconfirm your return flight booking at least 72 hours before travel. Failure to reconfirm your flight booking directly with the airline may result in cancellation.

Flights must be used in the order set out in your itinerary - eg a failure to use the outbound flight or first stage of a journey could invalidate the rest of the ticket.

We strongly recommend (particularly if you are flying Economy class), that you check in early if you have particular seat requests. Aviationlive CC T/A PickETicket.com has no control over the allocation of seats, even if pre-booked with the airline, and can make no guarantee that specific seats will be available on departure.

Aviationlive CC T/A PickETicket.com is not responsible for the costs of any transfers between airports or terminals that you may incur.

Flights priced at special fares or best prices may not take the most direct route. Some itineraries require a change of aircraft en-route. A flight that is described as direct is one where there is no need to change aircraft during the journey. However, stops may be made en-route for re-fuelling or to let passengers on and/or off. Details of any stops will be given during your booking process and are clearly identified both on the Site and on your itinerary which will be sent to you when you confirm your booking.

The times given are given on the 24 hour clock system, approximate and based on outbound flights. They may vary depending on flight schedules, type of aircraft, weather conditions etc., and are indications of the hours spent actually flying (excluding time on the ground during stops en-route or when changing aircraft) and are therefore given for guidance only and are subject to alteration and confirmation.

Regulations vary with each airline, but some will refuse to carry women who will be 28 weeks or more pregnant on the date of return travel. If in doubt, please check with the airline concerned and consult your doctor. Infants must be 6 weeks old or more to travel by air and must either sit on an adult's lap or occupy an infant seat. Please contact the airline you are travelling with for details of appropriate seats. Generally children aged 2 years or more must occupy a seat.

In the event that you make any alteration to your flight booking (including, but not limited to, cancellations, refunds and amendments), Aviationlive CC T/A PickETicket.com reserves the right to charge you an administration fee of $25 USD OR R250 ZAR per person to cover the administration costs incurred by Aviationlive CC T/A PickETicket.com. These charges do not include any charges imposed directly by the Travel Supplier or any difference in the fare as advised by the airline at the time of making the change. Credit card fees and booking fees are non-refundable in the event of cancellation (either by you or the airline/Travel Supplier). Please note that airlines do not generally allow name changes on flight bookings.

One-way combinables

In certain cases, in order to provide special return fares, we combine two one-way fares on different airlines or on the same airline. This means that you will have two separate bookings (one for your outbound flight and one for your inbound flight) and each booking will have its own fare rules. If you need to cancel one of the flights, you could keep the other without incurring any additional charges. However, if you miss the outbound flight, the inbound flight would not be cancelled by the other airline. Any cancellations, schedule changes or other modifications to one of the flights will not affect the other flight, and the fare rules of the other flight will still apply. For example if one of the flights is cancelled, the other airline has no obligation to refund the other leg of your journey or offer you an itinerary change. You may incur costs for any changes to the other flight if necessary.

Low-cost airline flights

If you instruct us to include low-cost airlines in your flight search, we will search the low-cost airline database, and then if you choose to buy, we will process the booking on your behalf. You will receive a confirmation email directly from the low-cost airline.

Your contract will be with the relevant low-cost airline. You will be subject to the terms and conditions of the low-cost airline which will be deemed to be incorporated into this contract. These can be viewed before you complete your booking, by clicking on the Terms and Conditions link, after booking on your confirmation email or on the low-cost airlines website.

Please note that low-cost airlines may depart from smaller, regional and/or secondary airports.

Hotels and other Accommodation

We offer star ratings as a general guide. You should be aware that these are not necessarily the official local rating and that standards can vary between hotels and accommodation of the same class in different countries, and even in the same country. Different countries have different standards; a 3 star hotel in one country is not necessarily equivalent to a 3 star hotel in another.

Check-in / Checkout times - Generally guests can check into a hotel or other accommodation around 3pm and check out at 11am, local time. However, local variances may apply. Should you require more precise timings, please contact us.

Images - Whilst we endeavour to ensure that property images and descriptions of amenities and facilities displayed on Aviationlive CC T/A PickETicket.com are an accurate and up to date representation of the properties, we cannot guarantee this always to be the case as we obtain this information from our Travel Suppliers. The images and information are provided to give a general 'feel' for the hotel.

Images of room types do not necessarily represent the bed configuration of the room being purchased. For example, a triple room in North America may consist of one double bed and one single bed or a double room in Austria may consist of two single beds. Also, there may be an additional charge for extra beds or cots. Please contact the hotel directly to confirm the exact bed configuration before purchase if required.

Breakfast is not included unless otherwise stated. Some hotels may charge additional local taxes.

In the event of availability or quality issues with your hotel, we will use our best endeavours to relocate you to the same or superior category of accommodation. If you do not accept the alternative accommodation, you may cancel the booking and we will refund any fees. Should you wish to re-book a different property at a higher price, you will be liable for the additional cost.

In the event that you make any alteration to your hotel booking (including, but not limited to, cancellations, refunds and amendments) Aviationlive CC T/A PickETicket.com reserves the right to charge you an administration fee of $25 USD OR R250 ZAR per booking to cover the administration costs incurred by Aviationlive CC T/A PickETicket.com. Car rental

For car rental the following amendment and cancellation terms will apply: for reservations cancelled or amended Aviationlive CC T/A PickETicket.com will impose a charge of $20 USD OR R150 ZAR per rental. For reservations cancelled or amended more than seven days after the booking date, Aviationlive CC T/A PickETicket.com will impose a charge of $60 USD or R500 ZAR per rental. Please note that after booking, additional charges may be payable for car rental (eg optional insurance, additional drivers, mileage) as further set out in the specific car rental terms and conditions.

General

As part of the booking process for flight tickets or hotels you are given the option to enter the details of any relevant frequent flyer or hotel loyalty programme of which you are a member. Please note that any such frequent flyer or hotel loyalty programme is subject to the terms and conditions of the airline or hotel through which it is offered. Those terms and conditions may not give rewards on all types of fare and class of service. Please contact the airline or hotel in charge of your frequent flyer or hotel loyalty programme if you are unsure of its terms and conditions. Please note that our Travel Suppliers have their own rules and regulations with regard to loyalty cards. If you have any questions, please contact them directly.

In relation to the 'special requests' options relating to any product (e.g. meals, disabled facilities, child seats etc.), Aviationlive CC T/A PickETicket.com does not guarantee any such requests but will pass these requests on to the Travel Supplier/hotel. It is your responsibility to confirm with the Travel Supplier or hotel whether such special requests can be fulfilled.

Booking Enquiries & Reservations

Once the Client has filled in all applicable fields to initiate an enquiry regarding a particular destination, trip, tour or mode of travel on the Travel Agent's website www.picketicket.com (‘Website’), or has responded to an advertisement verbally or in writing, via e-mail or the internet or has, without reference to any of the aforesaid, asked for more details telephonically (collectively referred to as ‘the Enquiry'), the Website or the Travel Agent will prepare and provide the Client with an estimated cost of the Enquiry (online, by e-mail or telephonically) (‘the Estimate'). This Estimate is accepted by the Client when the Client proceeds with the steps as specified on the Website or accepts the Estimate verbally over the phone or via email. Full payment of the total value of the Estimate (‘the Price') as specified in the Estimate is required in order to confirm reservations with Principals (‘the Booking'). Once the online Booking or Booking affected by the Travel Agent has been completed and the Client has authorized PickETicket.com to process the payment by submitting the Booking for reservation, the Client will be supplied with an email that will contain the final details of their Booking (‘the Booking Confirmation Form'). In the case of air tickets, full payment for the Booking needs to be made by midnight South African time on the day that the Booking was made in order to guarantee the fare quoted according to the Booking Confirmation Form.

Destination Selection

The Client acknowledges that it has selected the itinerary and destination(s) constituting the Booking based on information gleaned from the internet. It also acknowledges that the internet booking has been compiled and is managed and up-dated by the Principal over which the Travel Agent has no control. Accordingly the Travel Agent cannot and does not guarantee that the itinerary and/or any destinations will comply in whole or in part with such advertised on the internet. Any right of recourse in that regard will be against the Principal.

Payment and Payment Terms

The full payment is due immediately by Visa, Master, American Express or Diners Credit Card, Electronic Funds Transfer or Cash Deposit at a bank, whichever is applicable. If the full payment is not received by midnight South African time on the day that the Booking was made, the Travel Agent or Supplier involved reserves the full right to cancel the Booking. In the event that payment has been made after the aforementioned deadline, the Client will be liable for any difference in price should the Client still want to proceed with the Booking at the higher price.

Aviationlive CC T/A PickETicket.com t/a PickETicket.com is a South African company and all transactions are processed in South African Rand. Therefore conversion charges may be levied by your merchant bank if payment is made from another country and/or in another currency other than South Africa. This fee is driven by the global treasury of the applicable credit card and is impacted by the change in daily exchange rates.

Credit Card Acquiring and Security :

Prices

Prices are quoted at the ruling daily exchange rate. Until the Travel Agent has received payment of the Price in full, it reserves the right to charge any fluctuations to the Client's account and the Client undertakes to pay for any such fluctuation on demand. The onus will be on the Client to check that there have been no changes in the Price prior to making full and final payment. Airfares are subject to the price and conditions quoted by the airlines. However, once payment of the Price in full has been received, the Price is guaranteed provided that the payment was made by midnight on the day that the Booking was made. Should the Client be a group booking and the group number deviates from the number required for the Booking, the Principal may reserve the right to re-cost the Price and raise a surcharge. Should any Client refuse to accept and pay such surcharge, it may result in the Principal cancelling the Booking and retaining any payment made. (The Travel Agent will be entitled to retain any service fees charged).

Service Fee

These fees cover the costs incurred by the Travel Agent in booking and servicing your travel reservation.

Responsibility/Hold Harmless

The Proposed Travel Arrangements are made on the express condition that the Travel Agent, its employees and agents, shall not be responsible for, and shall be exempt from, all liability in respect of loss, damage, accident, injury, illness, harm, trauma, death, delay or inconvenience to any Client (which shall be deemed to include the heirs, executors, administrators or assigns of the Client), their luggage, or other property, wherever, whenever and however the same may occur. The Client indemnifies and holds harmless the Travel Agent, its employees and agents accordingly. The Travel Agent, its employees and agents shall furthermore not be liable for any indirect and/or consequential loss or damages whatsoever.

Insurance

It is strongly advised that all Clients take out adequate insurance cover in order to cover instances such as cancellation due to illness, accident or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment. (Note that is not an exhaustive list). The Travel Agent will not be responsible or liable if the Client fails to take adequate insurance cover. It shall not be obligatory upon the Travel Agent to effect insurance for the Client except upon detailed instructions given in writing and all insurance effected by the Travel Agent pursuant to such instruction will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters accepting the risk. The Travel Agent shall not be obliged to obtain separate cover for any risks so excluded. Should the insurers dispute their liability for any reason, the Client will have recourse against the insurers only. Please note that various credit card companies offer limited levels of travel insurance, which the Travel Agent does not consider sufficient cover for international travel. The Client is advised to check with their respective credit card companies in order to obtain the specific details of the cover offered.

Travel Documents

Documents (vouchers, itineraries etc.) are only prepared and released on receipt of payment of the Price in full.

Passports, Visas & Health

It is the entirely the Client's responsibility to ensure that all passports and visas are current, valid, obtained on time, and will be valid for six months after return to their home country and that any vaccinations, inoculations, prophylactic (e.g. for malaria) and the like, where required, have been obtained. The Client is strongly advised to check the relevant requirements with the Travel Agent before travelling. The Travel Agent will endeavor to assist the Client but such assistance will be at the Travel Agent's discretion and the Client acknowledges that in doing so, the Travel Agent is not assuming any obligation or liability and the Client indemnifies the Travel Agent against any consequences of non-compliance. It is the Client's duty to familiarize him/herself with the inherent dangers of and mental and/or physical condition required for the Proposed Travel Arrangements.

Warning: Malaria and other tropical Diseases

Certain parts covered by the Client’s itinerary may be areas where there is a high-risk of malaria and other tropical diseases. The Client is strongly advised to take the necessary precautions in this regard and hence we recommend that the Client checks with their medical practitioner before departure or a medical practitioner well versed in tropical diseases immediately upon arrival at any tropical or sub-tropical destination. If this has not been done prior to departure, it is imperative to do so upon return.

Amendment Fees

An amendment fee per Booking or/and per Person may be levied for any changes to the confirmed itinerary and or ticket. This is charged in addition to the change fees charged by the Supplier.

Cancellation

In the event of the Client cancelling the Booking, the Travel Agent shall have the right to either claim an amount or to retain an amount of the payment and claim damages suffered by the Travel Agent. The Principals may reserve the right to cancel any services prior to departure, in which event the entire payment for the ticket will be refunded to the Client without any further obligation on the part of the Travel Agent.

The Travel Agent will charge a fee for processing the request for refund. (Clients should refer to the “Refunds” section of these Conditions, as well as the cancellation provisions contained in the Principal's Conditions, the Website. Principals may charge cancellation fees over and above these stated here).

Unscheduled Extensions

In the unlikely event of there being an unscheduled extension to the final itinerary caused by flight re-scheduling, flight delays, bad weather, strikes or any other cause which is beyond the control of the Travel Agent, its agents or the Principal, it is understood that expenses relating to these unscheduled extensions (hotel accommodation etc.) will be for the Client's account.

Itinerary Variations & Transfers

While every effort is made to keep to the final itinerary, Principals and/or the Travel Agent reserve the right to make changes intended for the Client's convenience e.g. in some cases, weather conditions can necessitate an alteration in the itinerary and this does not constitute any reason for a refund. It is the Client's duty to check each amendment to the itinerary.

Queries and Complaints relating to your Booking

Please contact our customer services team, if you have any other enquiries or complaints relating to your booking prior to departure.

If you have a complaint relating to a Travel Supplier and/or hotel during your stay, please ensure that you officially log your complaint with the relevant Travel Supplier and/or hotel prior to your return.

If you have any other enquiries or complaints relating to your booking during your stay, please contact our customer services team on your return and no later than 30 days after it giving your booking reference and all other relevant information. If we or any of our Travel Suppliers require further information you must supply that promptly in writing. This simple procedure must be followed as we and our Travel Suppliers need to be able to investigate the problem and, where possible, rectify it quickly.

Customer Behaviour

It is your responsibility to ensure that you do not behave in a way which is inappropriate or causes offence or danger to others or which risks damage to property belonging to others (including but not limited to drunkenness, air rage) whilst on your holiday or using a service/product. If your behaviour is inappropriate and/or causes offence, or damage to others, or risks damage to property belonging to others, we and/or our Travel Suppliers (e.g. airline staff) may cancel you booking, in which case our and our Travel Supplier's responsibility to you will cease immediately and you will not be eligible for any refunds, payments of compensation and/or any reimbursement of any cost or expenses you may incur as a result of such termination. Further, you will be liable to reimburse us for any expenses we incur as a result of such termination.

Use of the Site

The Site is provided on an 'as is' and 'as available' basis. Aviationlive CC T/A PickETicket.com does not accept any liability in respect of your ability to access or use the site at any time or any interruption in that access or use or any failure to complete any transaction. Aviationlive CC T/A PickETicket.com does not warrant that the Site is free from computer viruses or other properties that may cause loss or damage.

Information on the Site

Aviationlive CC T/A PickETicket.com offers all of the general information on the Site for purposes of guidance only. Please note that Aviationlive CC T/A PickETicket.com may at any time change any aspect of the Site or its content, including the availability of any suppliers, features, information, database or content. You need to check with the relevant Travel Supplier, destination, embassy, or tourist office to confirm the guidance is up to date. In particular, with respect to passports, visas, and vaccination requirements, Aviationlive CC T/A PickETicket.com does not guarantee that the information is always up to date and it is your responsibility to ensure that you understand and comply with all relevant passport, visa, and vaccination requirements.

Aviationlive CC T/A PickETicket.com does not guarantee that information on the Site (including without limitation prices, descriptions or dates) is free from errors or omissions but we will use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to our attention. By way of example, the majority of hotel and other accommodation descriptions are fed directly to our Site by the Travel Supplier or the hotels themselves.

Your Obligations

You agree to be bound by the following obligations, including without limitation:

You accept financial responsibility for all transactions made under your name or account.

You must be 18 years of age or over and have legal capacity.

You warrant that all information you provide about yourself or members of your household shall be true and accurate.

The Site must not be used for speculative, false or fraudulent bookings.

The transmission of threatening, defamatory, pornographic, political, or racist material or any material that is otherwise unlawful is expressly prohibited.

The Site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed or reproduced in any way by you, except that one copy of the information contained within the Site may be made for personal, non-commercial use.

Law & Jurisdiction

South African law and jurisdiction of South African courts will govern the relationship between the Client and the Travel Agent. The Travel Agent shall be entitled to institute any legal proceedings arising out of or in connection with this contract in any Magistrates Court having jurisdiction in terms of Section 28 of the Magistrates Court Act no. 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction.

Conduct

The Client agrees that he/she will at all times comply with the Travel Agent's or others' requirements in regard to his/her conduct and he/she will not in any way constitute a nuisance to any other passenger on the aircraft.

Special Requests

Clients who have special requests must specify such requests. Whilst the Travel Agent will use its best endeavours to accommodate such requests, it does not guarantee that it always can.

Amendments of these Conditions

No amendment, cancellation or waiver of any term or right referred to herein shall be valid or binding unless reduced to writing and signed by both the Client and a duly authorized representative of the Travel Agent.

Refunds

Refunds by the Principals will be subject to their respective terms and conditions. The Travel Agent will charge a fee for processing a request for refund. Principals may charge refund fees above those stated here. Some bookings be it flight, hotel or car in some cases can be not refundable.

Foreign Exchange Regulation Compliance

Foreign Exchange Regulation Compliance is the Client's exclusive duty. This will apply especially when the Client instructs the Travel Agent to make and pay for travel arrangements on the internet.

E-ticketing: Documents required for travelling

The Client must be ready to show their passport or identity document and e-ticket at the check-in counter of the airline concerned. Mango airlines require a copy of the credit card used to make payment in addition the above mentioned documents. Passport or identity document will apply to all members of a travelling party and for each minor travelling, including infants.

Internet Bookings

If the Client requests or instructs the Travel Agent to affect bookings via the internet, the Client irrevocably authorizes the Travel Agent to do the following on its behalf (1) make any selections of and for the Proposed Travel Arrangements (2) make payment of a booking and ancillary services and (3) accept booking conditions.

Limitation of Liability

The Travel Agent, its officers, directors, servants or agents will under no circumstances be liable for any claim, loss, damage or injury suffered by any person whether to their person or property, howsoever caused whether or not arising from any act, omission, default, or negligence on the part of the Travel Agent, unless such claim is due to the gross negligence of the Travel Agent and such claim is lodged in writing with the Travel Agent within 30 (thirty) days after the end of the Booking. Such liability will be subject to a limitation of R10 000 per Client per Booking and under no circumstances will the Travel Agent be liable for any indirect or consequential loss or damage.

Legal Fees

The Client will be liable for all legal fees of an attorney and own Client scale in the event that the Travel Agent has to engage a lawyer to enforce any of its rights or otherwise.

Confidentiality

Subject to statutory constraints or compliance with an order of court, the Travel Agent undertakes to deal with all Client information of a personal nature on a strictly confidential basis.

Confirmation of Travel Arrangements

All onward travel arrangements (local, international and on return to South Africa, domestic connecting flights) must be reconfirmed by the Client 72 (seventy-two) hours prior to departure.

General Terms and Conditions for Online Bookings

Bookings Online

Please note that over and above these online terms and conditions all bookings are subject to Aviationlive CC T/A PickETicket.com's Standard Terms and Conditions ('STC') which appear above - where there is a conflict between the two, the STC will prevail.

Intellectual Property

The website www.picketicket.com are owned by Aviationlive CC T/A PickETicket.com and the domain name is registered in the name of Aviationlive CC T/A PickETicket.com. Aviationlive CC T/A PickETicket.com is a company incorporated and situated in South Africa. All intellectual property rights in and to the aforementioned vests in the owners as indicated. None of the content or data found on this site may be reproduced, sold, transferred, or modified without the express written permission of Aviationlive CC T/A PickETicket.com.
